Google's Eric Schmidt slams patent wars, still has nice things to say about Apple and Samsung

Eric Schmidt's recent trip to Seoul wasn't all spontaneous Gangnam dancing. Google's former-CEO / current executive chair had a lot to say during the Korean launch of the company's Nexus 7 tablet, bemoaning the patent wars that have ensnarled the industry, telling the crowd, "literally patent wars prevent choice, prevent innovation and I think that is very bad. We are obviously working through that and trying to make sure we stay on the right side of these issues." The war for marketshare ought to be fought with the release of better products, rather legal maneuvering, according to the executive.

But in spite of Apple's role in the battle -- and the company's decision to go it alone on products like its troubled Maps app -- Schmidt still had kind words for Cupertino, calling the company "a very good partner," and adding that the, "two companies are literally talking all the time about everything." The exec also told the crowd that he'd be meeting with Samsung, one of the company's "most important partners," during the trip, "as I do every time I come here."

How Usher Beat The Fatherhood Odds | Praise 1300

?

More than four years ago, in one of my first columns for The Root, I wrote about pop star Usher Raymond?s proud papa moments in a piece titled ?What My Father Could Learn From Usher.?

At the time black fatherhood was dominating the airwaves with shows featuring Snoop Lion (n?e Dog), Deion Sanders and Rev. Run. Adding to the list of Cliff Huxtable heir apparents was Usher, who had just married Tameka Foster, the mother of his unborn son. The wedding wasn?t well-received by fans or Usher?s own mother, Johnetta. The ?controversy? baffled me because all I could see was a man standing up for the woman he loved.

As a fatherless child, I was awed by Usher?s 2008 appearance on MTV?s TRL. Addressing the rumors swirling around his new marriage and threatening to suck it down into a tabloid abyss, Raymond grabbed a mic and looked all the haters out there in TV Land directly in the eye: ?I?m a black, strong man in America standing up for my people as a man,? Usher said to the camera.

?To my wife, to my son, to my family, I?m making a stand that a lot of us should make. I could?ve been like any other man who would have a child and just, you know, live with that woman and continue to just, you know, play the game. I?m tryna do it the right way. This is the way you should do it. Pay attention, fellas.?Four years ago I wrote that I?d wished my own father had received a message like that in 1980. A message about sticking around and sticking to your guns. A message about what men ?should? be doing as opposed to what too many men were doing. It resonated with me and with readers.

Sudan, South Sudan leaders make another push for border deal

ADDIS ABABA (Reuters) - Sudan and South Sudan leaders will try again on Tuesday to seal a border security deal after failing to achieve a breakthrough in the previous two days, officials said on Monday as both sides disagreed over whether progress had been made.

Sudanese President Omar Hassan al-Bashir and southern counterpart Salva Kiir have been meeting in Ethiopia since Sunday in hopes of wrapping up peace talks after coming close to all-out war in April.

The African Union has been striving to broker a demilitarized buffer zone at the unmarked and disputed border to allow South Sudan to restart oil exports through the north, which would give a big lift to both battered economies.

Both nations are under pressure after a U.N. Security Council deadline expired on Saturday, although it was extended unofficially until Thursday when AU mediator Thabo Mbeki will report on whether a deal has been done, diplomats said.

Bashir and Kiir originally planned a one-day summit but have so far failed to agree during three long meetings on the details of a buffer zone map proposed by the AU.

Sudan has reservations about a 14-mile-(23-km)-long strip of land mapped out, while Juba has accepted the formula.

Sudan said it was hopeful that Bashir and Kiir would successfully conclude the talks on Tuesday.

"Both leaders will discuss the issues tomorrow at 10 o'clock ... We expect all issues to be solved positively," El-Obeid Morawah, spokesman for Khartoum's foreign ministry, told reporters after Bashir and Kiir met for two hours.

"There (was) progress today regarding the issue of 14 miles and the controversial issues were minor today compared to other days," he said.

SOUTH SEES OBSTACLES

But South Sudan's delegation appeared more doubtful.

"We have been facing some obstacles during the presidents' discussions. We haven't been able to solve this yet but tomorrow a final session will be held," Atif Keir, spokesman for Juba's delegation, told reporters.

He said the talks would only succeed if Sudan complied with a road map for peace proposed by the African Union, which has been trying to broker a comprehensive peace deal.

The armies of both nations fought for weeks in April along the unmarked and disputed border after a dispute escalated over how much South Sudan should pay to use oil pipelines that traverse the north to Red Sea ports.

The two reached an interim deal in August to restart oil exports from landlocked South Sudan after Juba turned off its wells in a row over export fees.

But Sudan insists on first reaching a security accord.

South Sudan, where most people follow Christianity and animism, seceded from the mainly Muslim north in July 2011 under a 2005 peace agreement that ended decades of civil war.

Western and African officials had hoped for broad peace accord but several rounds of talks in Addis Ababa have brought no visible progress on settling the fate of five disputed border areas. This will probably be left to a future round of negotiations or possible lengthy arbitration. (Editing by Mark Heinrich)

Rhincrew Luke and Galtee Max in conflict for the Grade A2 500 ...

Rhincrew Luke and Galtee Max in conflict for the Grade A2 500 metres flat race ?

The Grade A2 500 metres flat has pulled together quite a few entries who have the potential to bag the ?102 prize money of the event. The 500 metres race will be hosted by Sheffield on Monday, 24th September. One of the most commendable and prosperous hounds up for the challenge tonight is the two-year-old brindle dog, Rhincrew Luke.

The lightly raced hound has progressed from the Grade T races to the Grade A2 and A3. He has won two out of the five career outings and has improved drastically through the last five races.

The N. Melbourne trained won the Grade A3 500 metres flat race on 11th September, 2012 at Sheffield. Breaking out of the second trap and then ruling over half the distance had him on the other end of the wire in 29.36 seconds. His lead of three lengths shoved Tamara into the second slot.

Striking a back-to-back, Archaton Pine?s son took charge of the track from the second spot, and landed the race in 29.78 seconds.

With the final ? of a length in his favour, the two-year-old had Outlier Rudi settling in the second position.

The 5 to 2 entry will once again race in the blue vest after having drawn the second trap.

A candidate to look out for is the two-year-old, Galtee Max. The E. Parker trained has a good fan following at Sheffield, and has won at the venue at several occasions. Ever since 12th May, 2012, he has raced over 500 metres only.

Crash?s son has won twice out of the last four outings.

He captured the Grade A2 500 metres flat on 20th August, 2012 at Sheffield. Picking up pace just when it was required, and then dealing with the cluster tactfully, had him charging on from the first spot, and reaching the wire in 29.67 seconds.

Next he nailed the Grade A2 500 metres flat race on 30th August, 2012 at Sheffield. Shifting from first to second stall did not break the winning composure due to the winning technique that got him beyond the wire in 29.57 seconds.

Galtee Max has drawn the box right next to Rhincrew Luke, the first trap.

Shane Bond backs Zaheer Khan to find form ? Cricket News ...

Shane Bond backs Zaheer Khan to find form ? Cricket News Roundup ? Part II ? September 24, 2012

Former New Zealand fast bowler Shane Bond on Monday backed under-fire Indian seamer Zaheer Khan to regain his lost form soon.

?Every fast bowler experiences that phase, when you just don?t get the rhythm. Nothing new in that and Zaheer is just going through a rough patch. It?s all about rhythm,? said Bond, 37, while rejecting 'too much talk'.

The 33-year-old left-arm medium pacer hailing from Maharashtra has come under fire recently, after struggling against New Zealand, Sri Lanka, Pakistan and Afghanistan in T20 matches. Whilst the veteran seamer managed to claim at least one wicket each against the Black Caps and the islanders, he struggled for penetration against the rest of the two opposition. What brought Zaheer?s performance under scrutiny was his figures of 32 for 0 against the inexperienced Afghanistan batting line-up last Wednesday.

South Africa?s World T20 squad is enjoying a two-day break at a luxury beach?in the southern Sri Lankan town of Bentota, ahead of their Super Eight campaign, commencing in Colombo, on Friday.

"We?ve had a hectic touring schedule over the last few months and we felt the next couple of days would be a great opportunity for the players to get away from cricket and to recharge their resources," said coach Kirsten.

The Proteas advanced to the next stage of the mega event after comprehensively defeating Group C competitors Zimbabwe and Sri Lanka. They will return to Colombo on Tuesday to start their preparations for the Super Eight stage opener against former champions India. Australia is the third team in the group while the fourth team will be decided based on the outcome of Pakistan-Bangladesh match on Tuesday.

Niall O?Brien, the middle order batsman of Ireland, hopes to remove talismanic West Indies opener Chris Gayle early on, come their must win match against the Caribbean side on Monday night.

?Hopefully one of the main bowlers can take a scalp early,? said O?Brien while speaking to media reporters on the eve of the do-or-die match. ?Gayle?s obviously a fine player but he's human, he can make a mistake. We need to make sure we take chance when it comes," he added further.

Australia has already qualified for the Super Eight stage and the winner of tonight?s match between Ireland and West Indies will be the other team from the Group B to advance to the next stage.

Education groups join opposition to union-backed Protect Our Jobs ballot proposal, supporters blast ad saying approval will lead to teacher strikes

GRAND RAPIDS, MI ? Opponents of the Protect Our Jobs ballot proposal say it?s not just businesses objecting to the union-backed measure to enshrine collective bargaining in the state constitution.

Citizens Protecting Michigan?s Constitution said five educational advocacy groups representing school boards and administrators have joined the fight against Proposal 2, saying the ballot proposal would turn back reforms and drive up costs.

The Protect Our Jobs coalition blasted the opposition group, calling it ?shadowy? and criticized an ad that said approving the measure would lead to ?Chicago-style? teacher strikes.

?Collective bargaining gives teachers a voice to negotiate for smaller class sizes so they can better educate our kids, time to complete ongoing training required by law and a say on policies that affect their students,? Protect Our Jobs Leaders said in a release. ?Student learning conditions are often improved by collective bargaining.?

Citizens Protecting Michigan?s Constitution spokesman Nick De Leeuw said the Michigan Association of School Boards; Michigan School Association of Secondary School Principals; Michigan Association of School Administrators; Michigan Association of Intermediate School Administrators; and the Michigan School Business Officials are opposing Proposal 2.

The group said the proposal is an attempt by unions to ?hijack Michigan?s constitution for their own financial gain.?

Attorney General Bill Schuette has said the measure would void all or part of 170 laws affecting public employee unions.

?Locally elected school boards across Michigan are responsible for ensuring our kids get the best possible education and for using our resources wisely, but Proposal 2 would set our schools back, eliminating critical reforms that help students succeed and driving costs through the roof,? said MASB Executive Director Kathy Hayes, representing 600 school boards. ?We urge parents to protect our schools, protect our students and to vote no on Proposal 2.?

MASA Executive Director William Mayes said Protect Our Jobs would cost districts $400 million in potential health care savings alone, forcing districts to cut staff and eliminate programs.

?Principals, like parents, want our students to receive the best education from the best teachers, but Proposal 2 would eliminate teacher evaluation systems and force us back into a seniority system that makes time on the job more important than performance with our students,? said Wendy Zdeb-Roper, executive director of the Michigan Association of Secondary School Principals. ?Proposal 2 threatens critical education reforms that help our kids succeed and we are asking parents to vote no.?

Citizens Protecting Michigan?s Constitution released an ad showing scenes of teachers striking in Chicago and saying approving Protect Our Jobs would lead to such job actions in Michigan.

The group released a Michigan Education Association memo that says strikes would still be illegal in Michigan, but unions would once again be able to negotiate for striking workers to be reimbursed for lost paychecks ? eliminating any penalties for walking off the job.

The group also said the measure would repeal the law requiring school bus drivers to have safety certificates.

Protect Our Jobs leaders lashed out, claiming the ad is ?intended to scare Michigan voters with lies, fear mongering and misleading information.?

The coalition called Citizens Protecting Michigan?s Constitution ?a shadowy front group for corporate special interests.?

?The claims in this ad are false,? Lynn Jondahl, a former Democratic state legislator who also served as the chair of the Michigan Board of Ethics, said in a release.

?Proposal 2 does not change the current prohibition on teacher and public school employee strikes, nor does it change current law regarding safety certificates for school bus drivers, which leave that responsibility in the hands of elected school boards.?

A release from the group said claims in the ad are ?lies.?

?The Proposal 2 amendment language states, ?No existing or future law of the State or its political subdivisions shall abridge, impair or limit the foregoing rights; provided that the State may prohibit or restrict strikes by employees of the State and its political subdivisions.??

Mick Fanning and Kelly Slater safely reach the quarter-finals at 2012 Hurley Pro

The fifth round of 2012 Hurley Pro, sixth of ten stops on the Association of Surfing Professionals (ASP) World Championship Title, kicked-off at Lower Trestles in California, America, on Thursday, September 20, with both Australia?s Mick Fanning and America?s Kelly Slater walking away with top honours from their respective heats.

Fanning got the better of his fellow countryperson Julian Wilson in the opening heat of the round to secure his place in the quarter-final while removing the latter from the contention for the event title.

The second heat saw France?s Jeremy Flores failing to down Slater, though just barely, consequently getting eliminated from the competition while sending the latter into the next stage of the competition.

The clean three-to-five foot waves on offer at the iconic beach-break of Lower Trestles set up an exciting stage for the elite ASP surfers to cut loose while competing for a place in the quarter-finals.

The first heat saw Fanning and Wilson taking each other on in a one-on-one battle for survival. Both the surfers had seemed a bit rusty during their previous heat and therefore found themselves standing on the edge with hardly any room for error.

As the bout got underway, Wilson got off to an energetic start, earning a 6.33 off his first business-wave and soon backed it up with a 6.43-point ride to move to a heat-total of 12.76 points.

Fanning, former two-time ASP World Champion and current No.1 on the 2012 ASP World Championship Tour rankings, did not get off to the best of starts, but a determined search eventually allowed him to get his hands on a 6.07 and 6.83-point ride, thus finishing with a heat-total of 12.90 points. The score was just enough to take him ahead of his rival and consequently secure the quarter-final spot.

The second heat saw the legendary Slater, reigning 11-time ASP World Champion, take on Flores in a pressure battle.

The 40-year-old Florida-based surfer went down to work right away and managed to score an impressive 8.17 off his first business-wave. With a 7.77-point ride late in the heat, the American surfer reached a heat-total of 15.94 points.

Flores responded with a couple of scores in the seven-point range, thus finishing with a two-wave total of 15.44 points. As a result, he was forced to concede the quarter-final spot to his rival.

Commercial Real Estate Recovering at a Slower Pace - Jeannette ...

Last updated 1 day 8 hours ago

Commercial Real Estate Recovering at a Slower Pace

WASHINGTON (August 27, 2012) ? Positive underlying fundamentals continue to support all of the major commercial real estate sectors, but a slowdown in job creation and ongoing tight loan availability has tempered growth in some areas, according to the National Association of Realtors??quarterly commercial real estate forecast.

Lawrence Yun, NAR chief economist, said there are mixed results among the commercial sectors. ?Job creation in the second quarter was about half of what we saw in the first quarter, which is moderating demand in the office sector,? he said. ?Industrial and warehouse space is holding on better because imports and exports have advanced. While exports to Europe generally are down, trade has been robust with India, China and other Asian nations, along with Brazil, Mexico and our strongest trading partner ? Canada.?

Although still positive, dampened demand is slightly moderating rent growth with the exception of the multifamily market.? ?Sharply higher demand for apartments is causing rents to rise at faster rates,? Yun said.? ?A return to normal household formation will mean even lower vacancy rates and higher rents in the future.?

The current commercial real estate cycle has been driven by shifts in demand without an oversupply of new construction.? ?The difficulty small businesses have in getting commercial real estate loans for leasing or purchase is keeping a lid on demand,? Yun explained.? ?Multifamily is the only commercial sector with a notable growth in new space, with some lending provided through government loans.?

With the exception of multifamily, vacancy rates remain above historic averages seen since 1999. Over that timeframe the typical vacancy rate has been 14.4 percent for the office market, 10.1 percent in industrial, 8.1 percent for retail and 5.8 percent in multifamily.

Vacancy rates are marginally declining and rents are modestly rising in all of the sectors, but significant changes in the outlook are unlikely before the end of the year. Many corporate decisions on spending and job hiring are on hold given uncertainty over the upcoming elections, whether Congress will effectively avoid a ?fiscal cliff,? and unsettled issues such as health care and banking/financial regulations.

"Overall companies hold plentiful cash reserves, but they are hesitant to hire without clarity over how these outstanding issues will impact the bottom line,? Yun said.

"Commercial real estate gains could be thwarted if lending from small and community banks dry up from excessive regulatory compliance costs, and if international big-bank capital rules are applied to smaller lending institutions,? Yun added.

NAR?s latest Commercial Real Estate Outlook1?offers projections for four major commercial sectors and analyzes quarterly data in the office, industrial, retail and multifamily markets.? Historic data for metro areas were provided by REIS, Inc.,2 a source of commercial real estate performance information.

Office Markets

Vacancy rates in the office sector are expected to fall from an estimated 16.1 percent in the third quarter to 15.6 percent in the third quarter of 2013.?

The markets with the lowest office vacancy rates presently are Washington, D.C., with a vacancy rate of 9.4 percent; New York City, at 10.0 percent; and New Orleans, 12.8 percent.

Office rent is projected to increase 2.0 percent this year and 2.6 percent in 2013.? Net absorption of office space in the U.S., which includes the leasing of new space coming on the market as well as space in existing properties, should be 24.1 million square feet in 2012 and 47.8 million next year.

Industrial Markets

Industrial vacancy rates are forecast to decline from 10.7 percent in the third quarter of this year to 10.5 percent in the third quarter of 2013.

The areas with the lowest industrial vacancy rates currently are Orang

e County, Calif., with a vacancy rate of 4.6 percent; Los Angeles, 4.8 percent; and Miami at 6.8 percent.

Annual industrial rent is likely to rise 1.7 percent in 2012 and 2.4 percent next year.? Net absorption of industrial space nationally is seen at 59.8 million square feet this year and 67.2 million in 2013.

Retail Markets

Retail vacancy rates are projected to decline from 10.9 percent in the

third quarter to 10.7 percent in the third quarter of 2013.

Presently, markets with the lowest retail vacancy rates include San Francisco, 3.8 percent; Fairfield County, Conn., 3.9 percent; and Long Island, N.Y., and Orange County, Calif., both at 5.3 percent.

Average retail rent is forecast to rise 0.8 percent this year and 1.3 percent in 2013. Net absorption of retail space should be 10.3 million square feet this year and 20.1 million in 2013.

Multifamily Markets

The apartment rental market ? multifamily housing ? is expected to see vacancy rates drop from 4.3 percent in the third quarter to 4.2 percent in the third quarter of 2013; vacancy rates below 5 percent generally are considered a landlord?s market with demand justifying higher rents.

Areas with the lowest multifamily vacancy rates currently are Portland, Ore., at 2.0 percent; New York City and Minneapolis, both at 2.2 percent; and New Haven, Conn., and San Jose, Calif., both at 2.4 percent.

Average apartment rent is likely to increase 4.1 percent in 2012 and another 4.4 percent next year.? Multifamily net absorption should be 219,300 units this year and 236,600 in 2013.

The Commercial Real Estate Outlook is published by the NAR Research Division for the commercial community.? NAR?s Commercial Division, formed in 1990, provides targeted products and services to meet the needs of the commercial market and constituency within NAR.

The NAR commercial components include commercial members; commercial committees, subcommittees and forums; commercial real estate boards and structures; and the NAR commercial affiliate organizations ? CCIM Institute, Institute of Real Estate Management, Realtors? Land Institute, Society of Industrial and Office Realtors?, and Counselors of Real Estate.

Approximately 78,000 NAR and institute affiliate members specialize in commercial brokerage and related services, and an additional 232,000 members offer commercial real estate services as a secondary business.

The National Association of Realtors?, ?The Voice for Real Estate,? is America?s largest trade association, representing 1 million members involved in all aspects of the residential and commercial real estate industries.

'Watch,' 'House,' 'Curve' land in photo finish

(AP) ? Hollywood is in photo-finish mode with three new movies bunched up tightly for the No. 1 spot during a sleepy weekend at the box office.

Studio estimates Sunday put two movies in a tie for first-place with $13 million each: Jake Gyllenhaal and Michael Pena's police story "End of Watch" and Jennifer Lawrence's horror flick "House at the End of the Street."

And right in the same ballpark was Clint Eastwood and Amy Adams' baseball tale "Trouble with the Curve," which opened with $12.7 million.

Actual rankings will be determined Monday as studios release final numbers for the weekend.

No matter which movie comes out on top, it was another slow weekend for Hollywood, whose business has been sluggish throughout late summer. Revenues were down for the fourth-straight weekend, with all three of the top new movies opening to modest crowds.

"This was a clash of the non-titans," said Paul Dergarabedian, analyst for box-office tracker Hollywood.com. "When three films are duking it out for the top spot with only around $13 million, that doesn't represent a very strong period at the box office."

Overall domestic revenues totaled $88 million, down 25 percent from the same weekend last year, when a 3-D re-release of "The Lion King" led with $21.9 million, according to Hollywood.com.

The weekend's other new wide release, Lionsgate's sci-fi action tale "Dredd," opened well down in the rankings at No. 6 with $6.3 million. The movie features "Star Trek" co-star Karl Urban as a law enforcer and executioner in a crime-laden city of the future.

Open Road Films' "End of Watch" stars Gyllenhaal and Pena as partners patrolling the mean streets of LA. Relativity Media's "House at the End of the Street" casts "The Hunger Games" star Lawrence as a youth who moves with her mom next door to a house where bloody misdeeds took place years earlier. "Trouble with the Curve," released by Warner Bros., stars Eastwood as an aging baseball scout whose daughter (Adams) accompanies him on his latest road trip.

Studios determine weekend estimates by counting Friday and Saturday ticket sales then projecting Sunday revenues based on how similar movies have played out in the past. On rare occasions when the top movies are this close, the rankings sometimes change when Monday's final numbers are released.

That has led to grousing among competitors that some studios might be inflating their Sunday estimates to gain No. 1 bragging rights, even if only for a day.

"I took the high road myself and put down the $12.7 million we reported," said Dan Fellman, head of distribution at Warner Bros., where Eastwood has been based for decades. "I've got a major actor with a solid group of people in this movie, and I don't want to eat crow on Monday."

Other studios were tracking "End of Watch" and "House at the End of the Street" at a bit less than $13 million for the weekend, and some had "Trouble with the Curve" at No. 1 by a fraction.

"It's unbelievably close. I honestly don't remember ever seeing it this close, but we're happy that we're in the race," said Kyle Davies, head of distribution for Relativity. "We think our estimate is on target."

"We'll see tomorrow. I think today everybody projected honorably and honestly," said Tom Ortenberg, chief executive officer for Open Road Films. "I think it's fair to say that nobody's sure who's going to be No. 1."

While audiences were not too excited about the new wide releases, Lionsgate's Summit Entertainment banner had big crowds in limited release for its teen drama "The Perks of Being a Wallflower."

The film took in $244,000 in four locations for a strong average of $61,000 a theater. That compares to meager averages ranging from $3,960 to $4,762 a theater for "Trouble with the Curve," ''House at the End of the Street" and "End of Watch," which all played in about 3,000 cinemas.

"Perks" features "Harry Potter" co-star Emma Watson alongside Logan Lerman and Ezra Miller in the story of a troubled high school freshman taken in by a clique of senior misfits.

Senate approves resolution on Iran

(AP) ? The Senate has overwhelmingly approved a resolution that reaffirms U.S. efforts to stop Iran from developing a nuclear weapon and says containment of a nuclear-capable Iran is not an option.

By a vote of 90-1 early Saturday, the Senate backed the nonbinding measure that specifically states that it should not been interpreted as an authorization for the use of military force or a declaration of war.

Passage of the resolution comes as Israeli Prime Minister Benjamin Netanyahu has pressed Washington to spell out what would provoke a U.S.-led military strike against Iranian nuclear facilities. The Senate acted in the final hours before Congress broke for its weekslong recess.

The measure was introduced months ago by Sens. Lindsey Graham, R-S.C., Bob Casey, D-Pa., and Joe Lieberman, I-Conn. It endorses continued economic and diplomatic pressure on Tehran until it agrees to suspension of its uranium enrichment program in compliance with U.N. Security Council resolutions, cooperates with international inspectors and reaches a permanent agreement that its program is for peaceful purposes.

Sen. Rand Paul, R-Ky., who cast the only "no" vote, had spoken out against the resolution as an excuse for the use of military force.

Congress has passed ? and President Barack Obama has signed ? tough sanctions on Iran to limit its oil sales, hamper its economy and make it difficult for Tehran to finance its uranium enrichment program.

In US, stocks higher; in Europe, vows to save euro

NEW YORK (AP) ? U.S. stocks opened higher Friday, with investors hopeful after a few U.S. companies reported higher earnings and European leaders raised hopes that the continent is working out its crippling debt crisis.

The Dow Jones industrial average was up 28 points 13,625 early Friday. The Standard & Poor's 500 was up six to 1,466. The Nasdaq composite index was up 19 to 3,195.

Darden Restaurants, parent of Olive Garden and Red Lobster, reported a higher profit in its latest quarter. The stock rose $2.47, or more than 4 percent, to $57.19.

Homebuilder KB Home swung to a quarterly profit following a loss in the same period a year ago. The company also reported higher revenue. KB Home's rose 85 cents, or more than 6 percent, to $13.96.

Apple, propelled by the frenzy around the release of the iPhone 5, rose $4.49, or less than 1 percent, to $703.19.

In Europe, Italy's premier and Greece's prime minister met and repeated their conviction for "the absolute need to safeguard the integrity of the eurozone," according to a statement from the Italian leader's office.

Spain appeared near to working out terms for requesting a bailout from Europe.

The market has been barreling higher, not so much because people have been hopeful about the economy but more by actions from the Federal Reserve and other central banks around the world. In recent days, the Fed and other central banks have ramped up their commitments to rescue their countries' economies.

And despite the higher stock prices, reminders are abundant that the underlying economy is far from healed. Just this week, business activity in China and Europe has proved disappointing. In the U.S., Norfolk Southern and FedEx, considered bellwethers of the overall economy, have warned that businesses are shipping fewer goods or opting for cheaper service.

Free Legal Question: Criminal Law | California | I was released from ...

I was released from jail on my own recognizance after doing 44 days in jail to enroll into "Collettes Children's Home". I failed "Collette's Children's Home" drug test a month ago before I went to court on August 24, 2012. However, I also enrolled into counseling which was also court ordered and went to self help meetings and got a sponsor. The day before court I was assigned a probation officer who told me to tell the judge everything and i did. The judge let me stay out of jail and continue to try to enroll into "Collettes Children's Home". It has been a month now and I had a chance today to get into "Collette's Children's Home" however again I failed their drug test. The reason why I am court ordered to enroll into "Collette's Children's Home" is because I have a 13 year old daughter and I don't know any other program that takes 13 year old children. My daughter recently told her dad who has custody of her also that she didn't want to live with me. I tried to make her stay with me in a sober living residence but she kept going back to her dad's place. My daughter told her dad that she wants to live with her brother and her brother agreed so now she lives with her brother. I told my husband and my son that she need to stay with me but they didn't want her to stay with me so I became depressed and relapsed. Then "Collette's Children's Home" had an opening and I went to apply and failed their drug test gain. I go to court in 4 days. What shall I do? Or what can I do? Can I try to get into another program without my daughter? What do you think the judge would say? Will he put me in jail?

(AP) ? While the man behind an anti-Islam movie that ignited violence across the Middle East would likely face swift punishment in his native Egypt for making the film, in America the government is in the thorny position of protecting his free speech rights and looking out for his safety even while condemning his message.

It's a paradox that makes little sense to those protesting and calling for blood. To them, the movie dialogue denigrating the Prophet Muhammad is all the evidence needed to pursue justice ? vigilante or otherwise ? against Nakoula Bassely Nakoula, an American citizen originally from Egypt.

In America, there's nothing illegal about making a movie that disparages a religious figure. And that has the Obama administration walking a diplomatic tight rope less than two months before the election ? how to express outrage over the movie's treatment of Islam without compromising the most basic American freedom.

"The thing that makes this particularly difficult for the United States is that ... we treat what most of us would refer to as hate speech as constitutionally protected speech and Americans don't appreciate, I think, how unusual this position seems in the rest of the world," said Lawrence Rosenthal, a professor at Chapman University's School of Law in Orange, Calif.

The situation also raises vexing questions about how far the government can and should go to protect someone who exercises their First Amendment right. In the past, for example, police have stood guard to ensure Nazis and the Ku Klux Klan could march without being attacked for their views.

But Nakoula's case invites scrutiny because the free speech he exercised with the film "Innocence of Muslims" has had such far-reaching and violent implications.

If the government were to overtly protect Nakoula, it could be seen by some as tacit approval of the film, and further enflame protests. Leaving him to fend for himself could have deadly consequences. There are examples of violence against others who have written or spoken against Muhammad.

So far, the government has acknowledged offering very limited assistance. Los Angeles County sheriff's deputies escorted Nakoula to an interview with federal probation officials. They did so in the dead of night and allowed Nakoula to cover his face. And early Monday, deputies answered his family's request for help leaving the house where they'd been holed up for five days so they could reunite with the 55-year-old filmmaker. All remain in hiding.

Department spokesman Steve Whitmore stressed the agency is not providing protective custody. He referred questions to federal authorities, who have declined to comment.

Jody Armour, a professor at the University of Southern California's Gould School of Law, said it's "not unusual at all for the government to step in and give a citizen in distress or danger special protection, but it can't unlimited. They're going to have to strike a balance."

A 14-minute trailer for the film posted on YouTube sparked violence in the Middle East, including an attack in Libya in which a U.S. ambassador was killed. Nakoula, a Coptic Christian and American citizen who served federal prison time for check fraud, told The Associated Press in a short interview last week that he was involved in management and logistics for the anti-Islamic film. Federal officials, however, told the AP they have concluded he was behind the movie.

Furor over the film has been widespread. Bahrain protesters used Twitter to organize demonstrations that included burning American flags in the nation that hosts the U.S. Navy's 5th Fleet. Pakistan's conservative Islamist parties sent out text messages, mosque announcements and made phone calls to bring out protest crowds, including about 1,000 people in the northwestern city of Peshawar on Sunday and hundreds who rushed the U.S. consulate in Karachi, sparking clashes with police in which one demonstrator was killed.

"Yes, we understand the First Amendment and all of this stuff," wrote Khalid Amayreh, a prominent Islamist commentator and blogger in Hebron on the West Bank. "But you must also understand that the Prophet (for us) is a million times more sacred than the American Constitution."

Were he in his native Egypt, Nakoula could be charged with "insulting religion," a crime punishable by up to three years in prison or could face the more serious charge of "upsetting national security," which carries a life sentence.

In America, the government can't even order that the video be removed from YouTube. All it can do is ask. And so far, parent company Google has declined, saying the video was within its guidelines for content. The company did restrict access to the video in certain countries, including Egypt, Libya and Indonesia, the world's most populous Muslim nation.

"This can be a challenge because what's OK in one country can be offensive elsewhere," the company said in a statement.

That's precisely the point about the First Amendment, Armour said.

"The reason it is a constitutionally protected interest is precisely because it may prove unpopular," he said. "Words and images don't just convey information, they are attached to consequences. That's when we really have to ask ourselves, 'What price are we willing to pay for that First Amendment interest?' And these are the times that really test our convictions."

In 1975, former CIA agent Philip Agee published a book detailing agency operations and disclosing the names of a number of CIA agents working undercover overseas, Rosenthal said. Even in that instance, the U.S. government didn't press criminal charges but instead revoked Agee's passport and sued him for the book's profits.

"It's not clear that there is, on the books today, a law that makes what (Nakoula) did a crime," Rosenthal said. "This is an extremely difficult problem."

Indeed, federal officials have said they are looking at Nakoula only in the context of whether he violated his probation for the fraud conviction. Under terms of his sentence, he was banned from using computers or the Internet as part of his sentence.

The probation issue "gives the government a relatively low visibility way of prosecuting him but not technically for what he said and how inflammatory it was," Armour said. "It may be a way of splitting the baby."

New research could provide new insights into tuberculosis and other diseases

ScienceDaily (Sep. 18, 2012) ? Researchers Patricia A. Champion and Matthew Champion from the University of Notre Dame's Eck Institute for Global Health have developed a method to directly detect bacterial protein secretion, which could provide new insights into a variety of diseases including tuberculosis.

The Champions point out that bacteria use a variety of secretion systems to transport proteins beyond their cell membranes in order to interact with their environment. For bacterial pathogens such as TB, these systems transport bacterial proteins that promote interaction with host cells, leading to virulent disease.

Previously, researchers have relied on methods that have fused enzymes or fluorescent markers to bacterial proteins to identify bacterial genes that are used to export bacterial proteins into host cells. However, these methods can't be used in the analysis of all bacterial secretion systems, which has limited understanding of the mechanisms that bacteria use to interact with host cells.

The Champions developed a modified form of bacterial proteomics using a MALDI-TOF mass spectrometer, which directly detects the proteins from whole colonies by ionizing them with a laser. This research revealed that the method was able to specifically monitor a specialized form of protein secretion, which is a major virulence determinant in both mycobacterial pathogens, such as TB, and Gram-positive pathogens, such as Bacillus and Staphylococcus species.

The Champions demonstrated that this new method is applicable to the study of other bacterial protein export systems that could not be effectively studied under previous methods. Their method could also help in the identification of compounds that can inhibit bacterial protein secretion.

The method's importance can be seen in the fact that there are approximately 2 million fatal TB cases each year, mostly in the developing world. Also, antibiotic-resistant strains of TB are appearing increasingly.

The Champions' research findings appeared in the journal Molecular and Cellular Proteomics. The research was funded by the National Institutes of Health and Notre Dame's Center for Rare and Neglected Diseases as well as capitalization funds from Notre Dame.

(AP) ? President Barack Obama says when it comes to unfair Chinese auto subsidies, he's fighting back ? but Mitt Romney's mostly talk.

Campaigning in Ohio, Obama announced a new challenge with the World Trade Organization, saying the subsidies have cost thousands of jobs at auto and auto parts companies.

Obama says: "It's not right, it's against the rules and we will not let it stand."

His move comes after Romney ramped up charges that Obama lets the Chinese get away with widespread trade cheating.

But at a rally in Cincinnati, Obama said all Romney's done is "send them our jobs." He says Romney's firm, Bain Capital, champions outsourcing, and his tax policies favor overseas production.

Obama says on trade, you've got to "walk the walk, not just talk the talk."

Obsidian Entertainment Raises $1.1 Million To Finance Project ...

Obsidian Entertainment Finances Project Eternity RPG With Kickstarter Campaign

Obsidian Entertainment raised over $1.1 million with their successful Kickstarter campaign to finance the company?s new Project Eternity RPG. The Irvine, California based developer has created many popular games including Star Wars: KotOR II, Neverwinter Nights 2 and Fallout: New Vegas.

The team working on the new game will include many of the same people who created such games as Planescape: Torment, Icewind Dale and Baldur?s Gate, including Feargus Urquhart Josh Sawyer, and Chris Avellone.

Tim Cain, of Fallout, Arcanum and Temple of Elemental Evil fame, will also be involved in the development of Project Eternity.

The fund raising campaign surpassed everyone?s expectations, roaring to its initial goal in just over 24 hours. ?Project Eternity is going to be a reality because of you,? Obsidian wrote in an email sent out to backers. ?We?ve hit our goal quicker than anyone expected, and the last day has been overwhelming.?

The project now has almost 27,000 individual backers and it is just beginning its second day. One has to wonder of this is the future of financing for smaller, independent gaming companies.

Obsidian is hoping to raise even more money for Project Eternity now that the base goal has been reached. Taking the campaign to the next level,? they added a new list of goals to their Kickstarter page:

?1.1 million, Base Goal ? Achieved!
Base game includes three races, five classes, and five companions. We have ideas for these, but we want to hear your opinions on what you?d like to see. Stay tuned to Kickstarter, our website, and our forums to join in on the conversation.?

?1.4 million, New Playable Race, Class, and Companion!
Expands your options for character creation and adds a companion of the new class.?

?1.6 million, a Mac Version of Project Eternity and The Story Grows!
We?ve listened and we?ll make a Mac version of the game at this tier. We?re also going to add a new major storyline along with new quests, locations, NPCs, and unique loot (special histories everyone?).?

?1.8 million, New Playable Race, Class, and Companion!
The options grow for your main character and the roster of your motley crew expands with the addition of a new companion from the selected class.?

?2.0 million, Player House!
Get your own house in the game that you can customize, store equipment in, and where your companions hang out, or, as the elves say, ?chillax?.?

?2.2 million, a new Region, a new Faction and another new Companion! And, dare we say it? ? LINUX!
Great news, everyone! For the Tarball Knights of Gzippia out there, we?ll be adding Linux support!
Also, the world of Project Eternity grows in a major way with the inclusion of a whole new faction and the territory it holds. This adds new NPCs, quests, magic items, and hours of gameplay. And yes, you got it, another companion.?

The company also shared a detailed description of their plans for Project Eternity:

?Project Eternity aims to recapture the magic, imagination, depth, and nostalgia of classic RPGs that we enjoyed making ? and playing. At Obsidian, we have the people responsible for many of those classic games and we want to bring those games back? and that?s why we?re here ? we need your help to make it a reality!?

?Project Eternity will take the central hero, memorable companions and the epic exploration of Baldur?s Gate, add in the fun, intense combat and dungeon diving of Icewind Dale, and tie it all together with the emotional writing and mature thematic exploration of Planescape: Torment.?

?Combat uses a tactical real-time with pause system ? positioning your party and coordinating attacks and abilities is one of the keys to success. The world map is dotted with unique locations and wilderness ripe for exploration and questing. You?ll create your own character and collect companions along the way ? taking him or her not just through this story, but, with your continued support, through future adventures. You will engage in dialogues that are deep, and offer many choices to determine the fate of you and your party. ?and you?ll experience a story that explores mature themes and presents you with complex, difficult choices to shape how your story plays out.?

Raising seed money through a project financing website like Kickstarter has become one of the new age fundraising tools of the gaming industry. Tim Schafer?s company, Double Fine, raised $3.3 million to finance their new game and several other gaming companies are seriously considering online campaigns to raise money.

Would you be willing to donate to a Kickstarter campaign to help finance a new game? Would you even consider donating $10,000 to have an in-game NPC or item named for you?
